The community is invited to have its say on draft Local Planning Scheme No. 9.
The Shire of Dardanup has developed Local Planning Scheme No. 9 to replace current Town Planning Scheme No. 3.
The Scheme is a document used to control land use and development in the Shire of Dardanup. It specifies how the land may be used (zones) and developed and outlines the processes to be followed before development can occur.
Our expert Planners, apply the Local Planning Scheme to applications and proposals in conjunction with Scheme Maps, State Planning Policies and the applicable Local Planning Policies and Strategies.
Under State Planning Laws, Local Governments are required to review their Schemes every 5 years.
The purpose of Local Planning Scheme No. 9 is to:
- Set out planning aims and intentions for the Scheme area;
- Set aside land as local reserves for public purposes;
- Zone land and define its purpose;
- Control and guide development;
- Set out procedures for the assessment of development applications;
- Set out procedures for contributions made by land developers toward the cost of providing infrastructure connected with their developments;
- Make provision for the administration and enforcement of the Scheme.
The resulting document is a more contemporary land use planning scheme and has been prepared in accordance with latest amendments to the Planning and Development (Local Planning Schemes) Regulations 2015.
Submissions must be lodged on or before 4:00pm, 23 May, 2023.
Plans and documents setting out and explaining the planning scheme are available for inspection at the Shire Council Offices – 3 Little Street, Dardanup and 1 Council Drive, Eaton and at the Eaton Community Library – 2 Sanford Way, Eaton or can be viewed online via the below links.
Submissions on the planning scheme may be lodged in writing to the Chief Executive Officer, PO Box 7016, EATON WA 6232 or via email to submissions@dardanup.wa.gov.au
Submissions should include the name and address of the person making the submission and the property affected.

How will the Local Planning Scheme protect our environment?
There are a range of provisions in the draft Scheme aimed to assist with protecting the Shire’s significant environmental assets and values. Shire Staff have been working closely with officers from the Environmental Protection Authority to ensure the draft Scheme satisfactorily demonstrates how any potential impacts of future development on environmental values will be managed.
Of particular note is inclusion in the draft Scheme of a ‘Waste Precinct Special Use Area’ covering Lot 4580 Panizza Road and Lot 2 Banksia Road, Crooked Brook where existing facilities and operations are located. Introduction of a ‘Special Use Area’ has allowed for significantly expanded provisions to address land use planning and environmental matters such as visual impact, water management, dust, noise, odour, flora and vegetation.
Details of the ‘Waste Precinct Special Use Area’ were developed in consultation with landowners and stakeholders via engagement activities undertaken in 2020 which included two workshops facilitated on behalf of the Shire by environmental planning consultant Urbaqua.
How do I know if the zoning of my property will change?
Access the Shire’s mapping software (Intramaps) which will allow you to compare the current and proposed zoning of your property. Landowners whose property is proposed to be re-zoned under the new Planning Scheme No.9 are invited to contact our Planning Officers on 9724 0000 or email records@dardanup.wa.gov.au to discuss in detail any queries on what the proposed change could mean for them.
What happens with my submission?
All submissions are acknowledged by the Shire on receipt. When the submission period closes on 23 May, 2023, all submissions received are reviewed and summarised. A summary of all submissions received, together with Officer comments, will be included in a report to Council.
Council will give consideration to the submissions and determine if modifications are required to the draft Scheme.
Once Council has adopted the draft Scheme, with or without modifications, it will be referred to the Western Australian Planning Commission for final approval.
