Liquor licences are issued by the Department of Racing, Gaming and Liquor (RGL), section of the Department of Local Government, Industry Regulation and Safety (DLGIRS)
As part of the application process, RGL requires confirmation from the local government that the proposed licence complies with relevant planning requirements.
This confirmation is provided through a Certificate of Local Planning Authority, commonly known as a Section 40 certificate.
A Section 40 Certificate (Form LLD/15) is a statement from the local government confirming that the proposed licensed use has the necessary planning approval, or is exempt from approval, and noting any planning conditions relevant to the sale or service of liquor.
