Food Premises
Food businesses in Western Australia must comply with the Food Act 2008, Food Regulations 2009, and the Australia New Zealand Food Standards Code.
These laws help ensure food sold to the public is safe and hygienic, helping prevent foodborne illness.
Important: It is an offence to operate a food business without registration.
Food Business Registration
All individuals, groups, and businesses selling food to the public must be registered with the Shire of Dardanup.
Food businesses are classified based on risk level:
- Very Low Risk
- Low Risk
- Medium Risk
- High Risk

Home-based Food Business
Home food businesses are limited to low-risk food activities only.
Foods that require temperature control (potentially hazardous foods) are not permitted.
Commonly approved foods include:
- Cakes (excluding cream), biscuits and baked goods
- Nougat, fudge, meringues, Turkish delight
- Jams, chutneys, relishes, pickled vegetables and sauces
- Repackaged low-risk confectionery
All applications are assessed individually to determine risk.
Your Responsibilities
Food business operators must notify the Shire of any changes, including:
- Change of ownership (new registration required)
- Change of premises
- Changes to food activities
- Business closure
